Swimming Pool Requirements

A swimming pool for the private use of residents and/or their invitees when located on the same property as said resident’s home and so constructed, as to be drained into a public sewer; and maintained in such a manner as not to become a health or safety hazard.  Such pool shall have prominent fixed depth markings and have rudimentary safety equipment in easy access of the tank.  Such safety equipment shall include a minimum of one approved life ring with line attached, one body hook with a staff half the width of the pool in length, and an ordinary first air kit.

YARDS IN WHICH POOLS ARE LOCATED MUST BE ENCLOSED WITH A WIRE FENCE NOT LESS THAN FOUR FEET (4’) NOR MORE THAN SIX FEET (6’) IN HEIGHT WITH SELF-CLOSING AND SELF-LATCHING GATES, CAPABLE OF BEING LOCKED.

No such swimming pool may be constructed before obtaining a permit to build same from the Building Department.  The applications for said permit shall set forth in detail, the location, size, depth, and type of construction, which shall conform in all respects to the requirements of the Building, Electrical and Plumbing Codes.

Scaled or dimensioned plan showing a cross-section view of the pool and the location of buildings, patios, fence or other enclosure, gates, pool equipment, swimming pool, and a physical description of the pool including wall, floor, deck finishes and diving facilities – if any, shall be submitted with the application for building permit.

Pools used for swimming or bathing shall be in conformity with the requirements of the City of Lincoln Park Code, provide, however, these regulations shall not be applicable to any such pool less than twenty-four inches (24”) deep or having a surface area less than two hundred and fifty (250) square feet, except when such pools are permanently equipped with a water recirculating system or involves structural materials.

Pool shall be constructed, installed and/or altered in conformity with the application approved by the enforcing official.  Any deviation from the approved application shall be approved “prior” to such change by the Department of Building and Safety Engineering.

Property damage resulting from the installation of any type pool shall be the liability of the owner and/or the installer of the pool.

No wall of a swimming pool shall be located less than six feet (6’) from any rear or side property line nor ten (10’) from any street property line. Swimming pools shall not be located in an easement.  Ramps and decks shall remain a minimum of three feet (3’) from side yard property line. Pools must be erected within the rear yard setback.  No pool shall be located less than ten  feet (10’) from any main or principal building or four feet (4’) from any accessory building  and provided that such installation or erection does not result in total site coverage in excess of the following:

  1. May not exceed 25% of required rear yard (35’) PLUS 40% of non-required rear yard (any depth over 35’).
  2. May not exceed 40% for Residential “A: and 40% for Residential “B”, maximum lot coverage (includes house and accessory buildings)

Hose bibbs and sill cocks having a hose connection shall have a vacuum breaker when yard hose is used for filling pool.  Requirements for underground pool installations are as follows:

THERE MUST BE TWO FEET (2’) OF SOLID GROUND BETWEEN THE BOTTOM OF THE POOL, AND THE TOP OF SEWER, OR THE SEWER MUST BE REPLACED WITH X-H CAST IRON PIPE.   FILTER SYSTEMS, CHEMICAL TREATMENT, POTABLE WATER SUPPLY, PROVISIONS FOR WASTE WATER DISPOSAL, SAFETY OR BATHERS, CONTROL OF EXCESSIVE POOL NOISE, AND GENERAL CARE AND MAINTENANCE OF THE SWIMMING POOL SHALL BE THE RESPONSIBILITY OF THE OWNER, SO AS TO PREVENT SAID SWIMMING POOL FROM BECOMING A POTENTIAL NUISANCE.

An Electrical Permit is required.  Minimum cost is ($25.00) plus by circuit cost.  A groundfault interrupter is required.  No pool shall be located under overhead service wires.  Pool accessories and pool lighting located within the ten feet (10’) of the pool shall be connected to a continuous grounded service, as must the pool itself.  Article #680 N.E.C. Pool lighting systems shall not be offensive to neighboring properties.  No electrical equipment within ten feet (10’) of the pool.
